Terms of Service

1. Agreement

These Terms of Service govern your use of LunchPlot at lunchplot.com and any related pages, invites, and shared plan links (the "Service"). The Service is provided by LunchPlot, the seller and your contracting party ("LunchPlot", "we", "us"). By creating an account, opening a shared invite, or otherwise using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. Accounts

You must provide accurate information and keep your login secure. You are responsible for everything that happens under your account. You must be at least 13 years old to create an account. We may suspend or close accounts that violate these terms.

3. LunchPlot Plus, trial, and billing

LunchPlot Plus is a paid subscription offered at $3.99 per month or $39 per year. New subscribers may receive a 7-day free trial. Unless you cancel before the trial ends, the subscription automatically converts to a paid plan and renews at the end of each billing period until cancelled.

You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep Plus access until then.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

4. Your content

Plans, itineraries, contacts, potluck items, votes, and messages you submit remain yours. You grant us a limited licence to host, display, and transmit that content so we can operate the Service — for example, showing your plan to the people you invited. You are responsible for having permission to upload contact details of other people and for what you share through invites.

5. Acceptable use

You agree not to:

• scrape, crawl, spider, harvest, or bulk-download any part of the Service, or use automated tools to extract data or content from it, except for well-behaved search engine crawlers acting within our robots.txt;
• reverse engineer, decompile, or attempt to derive the source code, prompts, models, or underlying logic of the Service;
• copy, reproduce, or create derivative works from the Service's code, design, page structure, wording, or AI prompt content;
• use the Service, its output, or data obtained from it to build, train, or market a competing product or service;
• resell, sublicense, frame, or white-label the Service without our written permission;
• interfere with the Service, bypass rate limits or access controls, probe for vulnerabilities, or access accounts or plans you were not invited to;
• use the Service to send spam, harass others, or share unlawful content.

6. Our intellectual property

The LunchPlot name, logo, site design, software, feature designs (including date mode, birthday mode, the conversation-prompt sets, the potluck board, and the live map and ETA experience), written copy, and AI prompt content are owned by LunchPlot and protected by copyright, trademark, and other laws. These terms grant you a personal, revocable, non-exclusive licence to use the Service as intended — no other rights are transferred.

7. Location sharing

Live location sharing is entirely optional and only shares your position with people on the same plan. Shared locations expire automatically about one hour after they are shared, and you can stop sharing at any time.

8. Third-party services

The Service uses third-party providers for maps and place data, AI features, payments, email and messaging, and analytics. Venue information, hours, and booking links come from third parties and may be inaccurate. Reservations you make through external booking links are between you and that provider.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, that location or ETA data will be accurate, or that AI-generated suggestions will be suitable. Meet-ups you arrange are your own responsibility — use good judgement when meeting people.

10. Limitation of liability

To the maximum extent permitted by law, LunchPlot will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim or $50.

11. Termination

You may stop using the Service and delete your plans at any time. We may suspend or terminate access if you breach these terms. The sections on intellectual property, acceptable use, disclaimers, and liability survive termination.

12. Changes

We may update these terms. Material changes will be reflected in the "last updated" date above, and continued use after that date means you accept the revised terms.

13. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The state and federal courts located in San Diego County, California have exclusive jurisdiction over any dispute.
